Terms and Conditions License Renewal

CONDITIONS FOR RENEWAL OF PORT LICENCE UNDER THE PORTS (ISSUE OF LICENCES) REGULATIONS, 1981

1. Applications for renewal of Port Licence under the Ports (Issue of Licences) Regulations, 1981 must be made on prescribed forms obtainable from the Director Port Operations, Mauritius Ports Authority, Mer Rouge, Port Louis.

2. The Port Licensee shall submit such information, as required by the Authority at the time of application for renewal, including copies of the details of the Shareholder/s and Director/s of the Company duly certified by the Registrar of Companies and bearing the seal of the latter, and where applicable a valid Bank Guarantee and Insurance cover. 

3. The issue of a Port Licence under the above Regulations does not relieve the Applicant from his obligation to comply with other provisions of the laws in force in Mauritius, including safety, security and environmental aspects pertaining to the port.

4. The Licensee shall be responsible for all damages caused to the Authority's goods or property as a result of his or his agent's acts or negligence, improper supervision, etc. All such claims would be directed to the Licensee for settlement.

5. The loss of the Port Licence must be reported immediately to the MPA and the Police.

6. The Port Licence must be surrendered to the Authority if the Applicant ceases to perform the business for which such licence has been issued.

7. The Port Licence is not transferable.

8. Application for the renewal of a port licence shall be made at least two months before its expiry. A person who fails to renew a port licence before the expiry of his licence shall, on renewal, be liable to a surcharge of the fee payable in respect of such licence, as specified in the Ports (Fees) Regulations.

A port licence will only be renewed subject to the following conditions:-

  • The Applicant should have no outstanding debt with the MPA at the time of application for the renewal of its port licence.
  • The Applicant should have been operating within the period for which a port licence has previously been issued. No dormant port licence would be renewed.
  • The Applicant must submit its Company’s Licence and its Trade Licence for the renewal period. 
  • Where applicable, Bank Guarantee should be renewed with the Authority.
  • Where applicable, Insurance Cover and any other relevant permits from other relevant authorities should be valid for the renewal period.
